In New York, the family law is separate from divorce and is handled by the Family Court where as the Supreme Court handles divorce matters. While many of the same issues in a divorce arise in family law cases, the Family Court is not limited to dealing just with spouses. The Family Court handles matters wherever there is a family relationship involved, even if that relationship is simply having a child in common between unmarried persons.

In New York, there are two types of courts for family cases:

Family Court: Handles cases involving families, even if they are not married, such as when they have a child together. This court hears cases involving child custody, adoption, child support, abandonment, and other family issues.

There are also guardianship cases, where someone who is not the child’s parent takes responsibility for the child. This can happen for several reasons, including when an immigrant child has been abandoned, abused or neglected. Family offense cases can also have immigration consequences similar to that of criminal case immigration consequences.
The proper handling of these cases can have very severe consequences similar to a criminal conviction, or other penalties such as restriction of contact between the people involved.
Many times, a family crime case is related to a criminal case. Both the criminal case and the family crime case can be handled at the same time so that the situation does not get worse and is completely resolved.
